Terms of Service & End User License Agreement (EULA) — Vola Board
Please read these Terms of Service and End User License Agreement ("Terms", "Agreement", or "EULA") carefully before using the Vola Board mobile application and accompanying online services operated by Vola ("we", "us", or "our").
By downloading, installing, accessing, or using the Vola Board application, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the application.
1. License Grant
Vola grants you a personal, revocable, non-exclusive, non-transferable, limited license to install and use the Vola Board mobile application strictly in accordance with these Terms and applicable App Store rules (including Apple's Standard EULA terms where applicable).
2. User Accounts & Registration
- You may access certain features in Guest mode, or create an account via Email, Google Sign-In, or Sign in with Apple.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must provide accurate, current, and complete information and promptly update any changes.
- You must be at least 13 years of age to create an account.
3. User-Generated Content & Zero-Tolerance Policy
Vola Board allows users to create, name, grade, and publish climbing routes, log ascent tick-lists, provide difficulty ratings, write comments, and set user display names ("User-Generated Content" or "UGC").
Zero Tolerance for Objectionable Content and Abusive Users
We enforce a strict zero-tolerance policy against objectionable, harmful, or abusive content and behavior.
You agree that you will NOT create, upload, post, share, or transmit any content (including route names, descriptions, usernames, or comments) that:
- Contains defamatory, libelous, harassing, threatening, abusive, or hateful language;
- Contains profanity, sexually explicit material, pornography, or vulgar depictions;
- Promotes discrimination, bigotry, racism, or violence against any individual or group;
- Infringes on any copyright, trademark, patent, trade secret, or other proprietary right;
- Constitutes spam, unauthorized advertising, or promotional solicitations;
- Impersonates another person, climbing entity, or misrepresents your affiliation.
Enforcement, Reporting & User Blocking
- In-App Reporting: Any user can report offensive or inappropriate climbing routes directly within the app by tapping the "Report" flag icon on any route preview screen. Reported content is immediately submitted to our moderation queue.
- User Blocking: Any user can block an abusive user directly from their profile view, immediately hiding their created routes, comments, and social feed entries.
- Moderation Action: Our moderation team reviews all reported content and abusive user reports within 24 to 48 hours.
- Immediate Account Termination: We reserve the right, in our sole discretion and without prior notice, to edit, reject, or permanently remove any content that violates these Terms, and to suspend or permanently terminate the account and access of any user engaging in abusive, harassing, or objectionable conduct.
4. Physical Climbing Safety & Inherent Risk Warning
Inherent Risk of Bouldering and Climbing
Bouldering and climbing are inherently dangerous activities that involve significant risk of severe physical injury, permanent disability, paralysis, or death.
- The Vola Board mobile application and its Bluetooth LED lighting system are designed solely as a training aid and convenience tool to highlight holds.
- LED hold illumination does NOT indicate that a climbing hold, angle, movement, or route is safe, suitable for your skill level, or structurally sound.
- You are solely responsible for inspecting your climbing wall, holds, crash pads, safety matting, environment, and physical condition before climbing.
- Always climb within your capabilities and ensure proper supervision, fall zones, and certified impact-attenuating climbing mats.
- To the maximum extent permitted by applicable law, Vola, its developers, and contributors disclaim any and all liability for personal injury, death, property damage, or losses resulting from the use of the app, participation in climbing activities, or reliance on displayed route data.
5. Bluetooth Hardware Interaction
The app interacts with compatible ESP32-based climbing wall LED controllers via Bluetooth Low Energy (BLE). You are responsible for ensuring that any hardware you build, wire, install, or operate adheres to electrical safety standards, proper voltage levels, and fuse protections. We are not liable for any electrical malfunctions, damage to LED strips, power supplies, or third-party hardware.
6. Intellectual Property & Route Data
By creating and publishing climbing routes on Vola Board, you grant Vola a worldwide, non-exclusive, royalty-free, perpetual license to host, display, distribute, and synchronize the route geometry, hold positions, and metadata across the Vola Board network and user community. You retain ownership of your personal submissions.
7. Account Deletion & Data Removal
You may permanently delete your account and all associated personal data at any time directly within the application by navigating to Settings > Account & Privacy > Delete Account & Personal Data, or by emailing us at beanboardclimbing@gmail.com.
8. Disclaimers & Limitation of Liability
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO EVENT SHALL VOLA, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE APPLICATION.
9. Changes to These Terms
We may modify these Terms at any time. When changes are made, we will update the "Effective Date" at the top of this document. Your continued use of the application following any changes constitutes your acceptance of the new Terms.
